Unrealized benefits and an inaccurate statement of overriding
consideration in the Final Environmental Impact Report.

The sale of water exceeds the entire City's annual budget and
the profit does’ fail to benefit the citizens of San Bernardino. Municipal Valley Water District exploits our land,
our natural heritage "water," and is an intruder in our neighborhood.
The project promise benefits that will occur as a result of the
North Lake project. It claim it will provide sufficient storage capacity to meet its near goal of 347 acre feet near existing
infrastructure including the Base Line feeder and service future water recipients. The City of San Bernardino should not approve
a project permitting the Municipal Valley Water District’s buy our land to sell water at $300- $450 per acre foot. There
are other alternatives to sell water; however, when water is surfaced the water is up for grabs and the land use is permanently
owned by the Municipal Valley Water District. The profit of water multiplies every year because of supply and demand. The
profiteering goes against the public good because we do not reap in their profit today or tomorrow.
It claim it will utilize surplus land surrounding the lake facilitating
new development and focus reinvestment in the community. The evidence is contrary to that benefit. Municipal Valley Water
District owns the 82.4 acres and the City of San Bernardino must purchase 25 acres. There is absolutely no guarantee that
there will be any redevelopment on those 25 acres.
The project claim to limit the spread of blight through
the development of new, aesthetically pleasing body of water. The evidence is contrary to that benefit. The project
of Seccombe Lake and Carousal Mall are examples to limit blight. The Sun note on June 27, 1965 in a full page headline
featuring blight in the downtown area as a disease which will spread unless 93 acres are razed for a mall. The project
of the Central City Mall is the result of the impact the Sun created. Forty four years later the prophecy of the sun
(for the record) is "incorrect"; therefore, we must be alert to view the Sun's opinion on any projects the City may have.
We know the outcome of the experts promising us benefits regarding to Seccombe Lake and the Carousal Mall. The Sun is in alliance
with the City and the Water district; however, history has proven the SUN missed the mark interpreting prophecy. So, the concept
of "blight" is not acceptable because of prior failed projects and prophecies.The
project promises a body of pleasant water as a destination. There is no evidence of water or a "river walk destination." After
all, San Bernardino is not San Antonio. San Antonio enriched in historical
data, properties, and landmarks since 1531 has a host of activities that draw people. What drawing card does San Bernardino
have to offer but a wrecking ball. The North Lake project is not a drawing card for San Bernardino but a bait and switch project.
The Final Environmental Impact report claim to limit blight,
but low income persons who reside in other areas will be deprived of the benefit because of the massive cost to support the
Lake project. The massive public subsidies in the North Lake project consume an unfair proportion of the City's resources.The Final Environmental Impact Report claim to limit blight, however, the impact to
neighborhoods adjacent to the residential lots and commercial pads during construction and prior to development is not addressed.
Also, the impact to the baseline area business district when commercial activity is eliminated and pads proposed for redevelopment
are vacant between the freeway and E streets and the impact when commercial activity on the west side of 9th between baseline
and 9th. The Final Environmental Impact Report failed to look at blight in those business districts, loss of sales tax from
displaced businesses, and loss of the City's share of property tax within the North Lake area. In
the statement of overriding considerations the Mayor and Common Council of the City of San Bernardino and the Board of Directors
of the San Bernardino Valley Water District find all feasible mitigation
measures have been imposed to lessen the impact less than a significant level where feasible, and furthermore,
that alternatives to the project are infeasible because they have greater environmental impacts, or otherwise socially or
economically infeasible
The evidence of the overriding consideration is contrary but a
need for greed by the Municipal Valley Water District and a need to get the people out in a disadvantaged area by the City
is evident and the purpose of the project. The unholy alliance between the City of San Bernardino and the Municipal Valley
water district is an Environmental Injustice and crimes against humanity.
