                    THE FIRST CHALLENGE: IS HIGH UNDERGROUND WATER A REALITY OR MYTH?
 
                             
                        WATER MUST STAY IN SAN BERNARDINO.
                 
 
The domcument above is issued by the San Bernardino Valley Municipal Water District March 2005.  Also, a map of the SBVMWD Groundwater Level Report pertaining to the well locations in the Bunker Hill Basin. The evidence is clear from examining the data that the repondents brief reply is in denial and resisting the Truth that San Bernardino for five years are the driest "ever".  The respondents claim that the project is an environmental necessity. Better  control of San Bernardino's underground water is the argument that makes this project essential, and the interaction  of the  Bunker Hill formation and the comtaminant plumes dictated the placement of the reservoirs.

In the respondent’s brief reply the issue of liquefaction was pointed out as an important issue by the water district. As the purveyor of water to both the Project site area, as well as a large surrounding area, the water district had, and still has, an immediate need for additional surface storage capacity in order to meet demands on their system in the event of an emergency, such as an earthquake. Recognizing that such a reservoir concept benefit not only the water district, but also San Bernardino, in August 1998, these two government entities, along with the Inland Valley Development Agency created a joint powers authority called the San Bernardino Regional Water Resources authority ("JPA"), to explore, in detail, potential solutions that might serve to meet not only the groundwater control issues, but also reduce, or eliminate, the blight (AR 8036)

The respondents brief, a reply, are correct that the outgoing mayor, Judith Valles and Patrick Milligan, the President of Muni has this Dream of the Lakes and Streams. The dream, however, of Valles and Milligan are not one in the same regarding to the end result of the project. The dream of Valles is an environment of a New City surrounded by Lakes and Streams. The dream of Milligan is a reservoir and the District's opportunity to sell wholesale water.  The water district’s keen insight that the political minds of San Bernardino are easily influenced by beliefs makes the North Lake Project an easy target. The water district would not be successful to convince the City of  Riverside of this project even though Riverside has a problem of  salt water intrusion. Ask how Riverside get their water and examine the pipe lines on Waterman Avenue serving water for Riverside. To question how the City of Riverside gets their water is to study the intelligence of the City of Riverside. It was voted in 1964 that the water of San Bernardino would not be sold to others and sell the water to cities downstream. The images of huge amounts of extra water that we call sell to people down the stream is the opium of the people and the downfall of this propaganda is the belief that  anything glorious that have a religious tone to it such as salvation is valid and true.

The respondents in their brief reply is in denial and fail to examine the data pertaining to High Ground Water Mitigation which the district has meetings of. Why does the district have high ground water mitigation meetings if there is nothing to mitigate? Why does the district have a concern pertaining to liquefaction if San Bernardino has the worse drought in history? Why does the district have a concern regarding to earthquakes if there is no evidence of liquefaction and high underground water? Finally, what is discussed at those meetings of  High Ground Water Mitigation knowing the results of the wells located in the Bunker Hill Basin?

 Mr. Harold Willis who served thirty five years as a water commissioner addressed serious issues regarding to the future of San Bernardino. The author would like to add to the comments of the former commissioner is that San Bernardino has many development projects on the agenda. If this is the case, how can San Bernardino continue to grow and meet the demand of development without adequate supply of water and the increase of population? 

The only concern for the water district is to have a reservoir and sell our natural heritage to others profiting from our land and the taxpayer who will carry the burden. 

The respondent brief, a reply, is in denial and has no interest serving San Bernardino. It really comes down to the fact that we the only entity west of the Rockies who is trying to get rid of water that does not exist or do not really have. So, what is really behind all this Greed?

Now, you may ask will the water table rise. Fortunately, nature has her own course and when it does rise the water is needed for our own needs and not for the Municipal Valley Water District dream and exploitation.

So, do we have a huge amount of extra water to justify the razing and suffering of two thousand souls? Or, are we in denial and resist the Truth in order to have a reservoir and meet the need of the water district and a pipe dream of Judith Valles and Patrick Morris? Did Morris buy into the Lakes and Streams "Dream" and made it the basis of this regenerating the City of San Bernardino? What is Morris plan pertaining to the surrounding neighborhoods knowing the problem of the water myth?

Patrick Morris should rethink this pipe dream and focus on the reality of "water." To clarify the view of Harold Willis who had to courage to stand independent from all the political forces and defend the natural heritage of San Bernardino. According to Mr. Willis he served thirty-five years as the San Bernardino water commissior earning $12 per month and six years as President  earning $25 per month. The desire of Mr. Willis  is simple and that is to protect his years of love and labor in serving the citizens of San Bernardino.

"You have been told we have this huge amount extra water that we can sell "to people down stream who need it." I was surprised to learn last March as MUNI meeting that we are in the worst drought in history. I learned this from MUNI District Publication. In the meeting MUNI talked about the tree growth rings, that these five years are the five driest "ever". Mark Bulot who is the representative of the "High Ground Water Mitigation" every two weeks throughout the year.

There are many reasons why Lakes and Streams are a terrible idea, but I can’t get past the fact that we are in the worst drought ever. City of San Bernardino’s Leroy Well is just outside the pressure zone at the 345 foot level. This is the lowest in history.

So, it really comes down to the fact that we are the only entity west of the Rockies who is trying to get rid of water they don’t really have." Harold Willis

  The North Lake project contains a number of attributes unworthy of state and federal attention and funding. This Environmental Injustice contains one significant attribute that will cause great harm to all cities sharing the Bunker Hill Basin. The water must stay in the Basin and must not be sold to people downstream who need it! Cities who share the Bunker Hill Basin and are served by  Valley Municipal Water District.

01/11/2006 Leviathan Prevailed. People Sold for Profit.

"The ultimate violence is razing 437 affordable housing units for 72 upscale homes in order to pave the way for the affluent. The justification for this violence is "limited options" and the bogus Bunker Hill argument; however, alternatives for the reservoir and treatment of contaminated water in the EIR proved the arguments of the respondents flawed. What I find most disturbing and violent is the invention of this project to raze an neighborhood and our fight to retain our affordable homes and seek Justice".Deanna

     The Second Challenge: Contamination or Extermination?

This part of "Will Leviathian Prevail" is the author's rebuttal of the Respondents arguments in their reply brief to the homeowners. The author argues the respondents flaw of contamination in order to justify razing an entire neighborhood.

The author is compelled to argue the matter pertaining to the Respondents argument

that the North Lake, a disguised Reservoir, is an Environmemtal Necessity. Upon reading, researching, and reading between the lines the author found no evidence of their arguments regarding the above and targeting the project area as the respondents described as "Environmental Necessity. The Respondents claimed the following: page 27 from their reply brief.

"Environmental injustice? Hardly! What was pursued what was conceived, what was reviewed, can be far better described as enviornmental necessity. Better control of San Bernardino's underground water has become essential, and the interaction of the Bunker Hill formation and the contaminant plumes dictated the placement of the reservoir(s)". page 27.

The respondents in their reply brief wrote "that the objections of the Petitioners have couched their objections almost entirely on emotionally - based, but wholly supported, contentions of evil intent and a lack of thoroughness of review". page 27.

Yes, the project is of evil content but not lack of thoroughness of review. The following is the response from the author pertaining to the bogus argument of the contaminant plumes dictating the placement of the proposed North Lake Reservoir.

Author's Research

The Bunker Hill groundwater basin has been polluted by contaminants from military and industrial use with mostly tetrachloroethylene (PCE) and trichloroethyl (TCE). About 8 square miles of groundwater are contaminated with PCE and TCE.. The Environmental Protection Agency (EPA) placed the Newmark site on the National Priority List to expand the required remedial actions. PCE and TCE exposure has been linked to development of cancer, damage to the nervous and immune system as well as birth defects. These organic solvents could have a detrimental impact to the health and safety of women of productive age as well as children and seniors in particular.

Two contaminated sites known as plumes are currently located North of the proposed North Lake project. These plumes are gradually migrating Southwards and slightly Eastward. These two areas of contamination are called the Newmark Operable unit and Muscoy Operable unit. Both of these flank the Shandin Hills area. Efforts are underway to clean these contimated sites under the guidance of the United States Environmental Protection Agency (USEPA) in order to limit the projected southeast migration of the Newmark Operable Unit. Clean up of the Newmark site began seven years ago and is estimated to go on for thirty years. Water treatment plants and barrier wells are expected to remove 11,500 pounds of the above mentioned contaminants.

With EPA assistance Muni obtained the property for seven extraction well sites whose construction began in 1996 and ended 1998. This is when cleanup from contamination of underground water started. Currently these are in operation and include the Waterman plant and 17th street/ Sierra for the clean up of the Newmark Plume or contamination site. In addition, there exists a number of extraction wells (at least 5)

along 11th street, South of Baseline between E street and Waterman. The objective of these is to limit the spread of the groundwater with PCE and TCE. In addition there are series of test wells South of this area also.

According to Ms. Kim Hoang, the remedial project manager( for region 9 )from the USEPA as of today, December 01, 2005 the five wells South of Baseline tested were found to be CLEAN and CLEAR of contamination, from PCE and TCE.

One can deduce from this negative well findings that the Southward migration of the Newmark Plume has been halted. Muni claims it is an environmental necessity to have the lakes and streams to be placed in the North Lake area in order obtain better control of San Bernardino’s underground water and the interaction of the Bunker Hill formation and the contaminated plumes. So, than if that area is clean what is exactly that Muni  wants to control over or perhaps this is a pretext to abate the people and our neighborhood?

According to the USEPA, Ms. Kim Hoang, the contamination is quite deep in some areas of the Newmark Operation Unit. Contamination has been found at depth of 400 to 500 feet. How is a Lake, or reservoir of 100 to 150 feet deep suppose to control the issue of contamination, if it exist at all in our particular neighborhood since so many factors come in play in this matter?

There are 10 extraction wells : 6 of them on the east side of the 215 fwy along 11th street between "E" Street and Waterman Ave. The other 4 extraction wells are located West of the 215 freeway.

 02/07/2006  Research from the EPA data on the CD was analyzed and examined by a specialist and concluded that the need for a reservoir to  treat contaminated  water and high underground  water  does not determine any action and need for a reservoir.

The outcome is a reflection of our moral fabric in our society. Will the Law reflect our consciousness in the realm of Belief or in the realm of Knowledge which Goodness is the highest and most important of all the Forms?

"A judge will not be a good judge if he is merely intellectual; he must also be united in the knowledge of Goodness because Goodness is the source of all truth. Unless a man knows what Goodness is, he will not be able to understand why Justice and Beauty, for instance, are good qualities. The man that knows that the Sun is the source of Light also knows that Goodness is the source of all Truth. To go forward with the North Lake Project is to violate Goodness and Justice and a Judge who is "Good" must return to his fellow men and apply the knowledge he has gained from this injustice. This moral man must return to the Cave and get used to the shadows again because he will have a broader understanding of the shadows before he left the cave. This man will know what the shadows really are what they are, and so he will be able to teach and guide his fellow prisoners in the right ways to find more appropriate solutions for the North Lake Project."Deanna

Imagine a cave, of men who have been prisoners since they were children. They are chained to the ground, and even their heads are fastened in such way that they can look only in front of them, at the wall of the cave. Behind the line of prisoners a fire is burning, and between the fire and prisoners there is a roadway. People walk along this road and talk to one another and carry things with them. The prisoners would see the shadows of those people, shadows thrown by the light of the fire on the cave all in front of them. And, supposing the cave wall reflected sound, the prisoners would hear sounds coming from the shadows. Since, the prisoners cannot turn their heads, the only things they will see and know are shadows and so they will assume that the shadows are real things, for they cannot know anything about the fire and the roadway and the people behind them.

Now, suppose we unchain one of the prisoners, and make him turn around. This will be very frightened and painful for him; the movements of his body will hurt him, and his eyes will be dazzled by the fire. And if we tell him the things he now sees are more real than the shadows, he will not believe us, and he will want to sit down again and face the wall of shadows which he understands. Now, suppose we go even further than this, and forcibly drag him out through the long tunnel into the sunlight. This will be even more painful and frightening for him when he arrives above the ground he will be blinded by the sun. But slowly, let us imagine, he will get used to it. At first, he will look at shadows thrown by the sun and at reflections in pools of water. Finally, he will be able to see the trees and mountains in full daylight, and he will recognize that these, not the shadows in the cave, are the real things. And when he has become accustomed to looking around him, he will at last realize that the light which makes all this possible comes from the sun.

And not, of course, he will be sorry for his fellows’ prisoners in the cave, and he will consider himself much luckier than they. If he were to be suddenly brought back to the cave, his eyes would be unaccustomed to the darkness, and he would no longer be able to recognize the shadows. His fellow prisoners would say that his experience had ruined him, and they would consider him a fool for going out into the daylight.

The allegory of the cave corresponds to the realm of belief, and the daylight world corresponds to the realm of knowledge. And the sun, of course, corresponds to the Form of Goodness. The prisoners of the cave are the inventors, authors, and promoters of  the North Lake project.

The North Lake project is invented in  the realm of belief, a belief that this project will enhance San Bernardino’s image. The North Lake project is based on unforeseen hope at the cost of hundreds of hard working and loyal citizens. This project is rationalized as an Environmental Necessity and evidence from the USEPA is contrary to the respondents reply brief. This project suffers from a belief that this project will be a tourist attraction and people of higher incomes would be attracted to San Bernardino. The first lowest stage is rationalizing environmental necessity for environmental injustice or profit is more significant than the value of human lives. The second lowest stage is rationalizing the letter of the Law as more significant than the value of human lives. Any law that subscribes to the approval of this project is in the realm of the lowest political stage in human evolution. The highest Law is the Law of Goodness because Goodness is a good quality and is the highest and most important of all the Forms. Our sight sees the Sun and sees it as a source of Light, and that makes objects visible, and allows the eyes to see. The prisoner who is confined to his condition finds the light painful because of the changes he has to make, but once the move has been successfully made, it can be seen, a move in the right direction. The conditioned minds of the prisoners are shadows and images which are patterns of their political, social, religious, and personal boundaries. According to Plato the second and lower kind of belief are our mental state when we see only shadows and images of physical objects. I do believe, however, that the images can be both physical and mental objects in the realm of belief as shadows of the mind. Anyone who has had a taste of knowledge and has seen the Form of Goodness will seem a fool to those who have never stepped outside the realm of mere belief. Many of our laws are in the realm of belief because the law lacks the highest form of "Goodness." Once a person is out of the cave and recognizes the forms he must diligently be a disciple of learning until ultimately Goodness unfolds itself. The realization that Goodness is the highest form is to know that all others’ are Forms in the realm of Knowledge and only Goodness is the source and outcome of the forms  that is  independent and yet part of the realm of Knowledge.  It is this independence of the all other Forms that makes Goodness the highest and most important of all the Forms. A man who does not know what Goodness is might certainly act rightly sometines, but he will also sometimes act wrongly. Only  true knowledge can guarantee that a man will always do what is best.
